Fair Use Clip Discussion

Over the course of three days, we are hosting a discussion on whether the clips posted below could be considered fair use of somebody else’s copyrighted material based on the Code of Best Practices in Fair Use for Online Video.
This clip was pulled from Kartemquin’s In The Family, a documentary film about one woman’s journey after learning she has the gene associated with breast cancer. Watch for audio clips and a CNN segment about Myriad Genetics. You may want to look at The Documentary Filmmakers’ Statement of Best Practices in Fair Use for a code that is more tailored to filmmakers, although the underlying arguements are the same:
“A Piece of Me” is a compilation in which every aspect of the video is taken from preexisting material:
Created a few years ago, “Bush Blair Endless Love” is a video about President Bush and Prime Minister Tony Blair during a particular time in our history:
Using the categories and the logic of the Code of Best Practices in Fair Use for Online Video, would you argue that the third-party copyrighted material is fairly used? Why? Why not? (Refer both to principles and limitations!) Are there “grey areas”? Where and why?
